Kildall Agency License Insurance Claims Reporting Procedures

It has come to my attention that some of my clients may not be aware of claims reporting procedures under their license insurance policy. One condition of all license insurance policies is the requirement to notify your agent or insuring company promptly of any incident that will, or may, result in a claim under the policy. We also ask that no statements be made to investigating personnel (except to protect the immediate safety of personnel, property or the environment) until you have consulted with an approved attorney. Although an investigator may not tell you so you do have the right to an attorney before making any statements. If you are uncertain whether or not an incident falls under the scope of your policy please contact us anyway.

In case of a shipping incident or casualty please take the following steps;

  1. Stabilize situation and make contacts as per your training
  2. We recommend that you do not make any statements to investigating personnel except to protect the immediate safety of personnel, property or the environment. Doing so could jeopardize your defense and you may tell any investigator that is why you choose to not talk with them until your attorney is present.
